چکیده

مطابق ماده 191 قانون مدنی ، آنچه که سازنده عقد است ، « قصد » می باشد که باید تحت شرایطی که مقنن در قانون برای آن تعیین نموده است ابراز گردد . از آنجایی که قانونگذار این ماده را در قواعد عمومی قرارداد ها گنجانده است ، بنابراین رعایت آن در تمامی قراردادها الزامی می باشد . با این وجود در عقد نکاح علاوه بر شرایط موجود در قواعد عمومی قراردادها ، در فقه یکسری شرایط دیگر نیز برای صحت ابراز قصد انشاء معتبر در عقد نکاح پیش بینی شده است ، که قانونگذار به آنها اشاره ای ننموده است ، اما با این وجود این مسائل در عرف جامعه مطرح می باشند ، وگویی از شرایط اساسی برای ابراز قصد محسوب می شوند . در این تحقیق ضمن بررسی این شرایط، به این نتیجه رسیده ایم که بسیاری از شرایطی که در فقه برای ابراز قصد انشاء معتبر در عقد نکاح مطرح است، جزو شرایط اساسی برای ابراز قصد نمی باشد، بلکه بسیاری از این شرایط ، بیشتر دارای جنبه احتیاطی بوده و فقها و حقوقدانان هم فقط آن را به علت اهمیت و جایگاه عقد نکاح مطرح نموده اند .
